Savonlinna Opera Festival online shop, terms and conditions of use

 

1. General
The Savonlinna Opera Festival online shop (hereinafter the Shop) is an online shop that functions as a reseller for tourism services and other ancillary products. The Shop is managed by Savonlinnan Oopperajuhlat Oy (hereinafter the Savonlinna Opera Festival). Product liability remains with the producers of the tourism services and souvenirs sold in the Shop. The Shop is intended for private individuals aged 18 or more (hereinafter Customers) who access the Shop in order to book or purchase tourism services or ancillary products sold there, for their own personal use. The language of the Shop is Finnish, and its currency is the euro (EUR). The Customer undertakes to accept these terms and conditions in accessing the Shop.

2. Shop managed by the Savonlinna Opera Festival
The Savonlinna Opera Festival shall be responsible for maintenance and accessibility of the Shop functions. The Savonlinna Opera Festival shall ensure that when the Shop is online it may be accessed using the following kinds of software and connections:

Minimum ISDN (64 kbit/s) workstation connection
 
Browsers for which the service is optimised:
Firefox 2.0 or later
Microsoft Internet Explorer 7.00 or later
 
The Savonlinna Opera Festival shall decide which Customers have access to the Shop and which products are offered for sale there from time to time. The Savonlinna Opera Festival shall decide how Customers may access the Shop and which means of payment they may use.

Means of payment
At the oopperajuhlat.fi online shop, payment can be made using credit cards through Suomen Verkkomaksut (2122839-7) or through online banking (the latter only in Finland).

Credit cards
In case the Customer wishes to make payment using Visa, Visa Electron or MasterCard, the Savonlinna Opera Festival shall only be considered to market the products and services concerned and to deliver any physical products to the Customer. Any complaints regarding the transaction shall be directed to Suomen Verkkomaksut Oy.
In case of payment made with Visa, Visa Electron or MasterCard, the product seller shall be Suomen Verkkomaksut Oy, and the transaction shall be concluded between Suomen Verkkomaksut Oy and the Customer. The seller shall be liable for any and all obligations related to the transaction. Suomen Verkkomaksut Oy shall also be the recipient of the payment in this case.

Online banking
Payment and financing services for transactions using online banking are provided by Suomen Verkkomaksut Oy (2122839-7) in cooperation with Finnish banks and credit institutions. Suomen Verkkomaksut Oy shall receive payment and forward it to the vendor. From the user’s point of view, there is no difference between this procedure and normal online payment. The online banking services of Osuuspankki, Handelsbanken, Nordea Bank, Sampo Bank and S-Pankki may be used in transactions at the Shop.

The price shall include services to the extent described on the product card and in the site description. If the online payment does not cover the entire price of the product, settling the balance will be described in further detail on the product card and in the site description. Any extra services that may be booked in connection with booking the product are priced separately.
Bookings made through the Shop shall be binding. Once the Customer has paid a deposit and/or the full price for the product or service through the Shop, the Shop shall send the Customer a booking confirmation, information on the site, the terms and conditions of booking and a receipt of payment to the e-mail address given by the Customer in the Shop. If the Customer does not receive a booking confirmation, the booking has not been registered. It is the Customer’s responsibility to check the information in the booking confirmation carefully, as the booking is binding.

A deposit charged in the Shop shall not be refunded under any circumstances (cf. Right of cancellation).
The Savonlinna Opera Festival shall be entitled at any time to block the Customer from using the Shop. The Savonlinna Opera Festival shall not be liable for the content of websites maintained by third parties to which there may be links in the Shop.

3. Identification and registration
For the Customer to conduct transactions and to book and purchase services in the Shop, the Savonlinna Opera Festival must be able to identify the Customer reliably. For this purpose, the Customer shall register in the Shop and receive a user ID and password. Customers registering in the Shop shall enter the required personal information truthfully and accept these terms and conditions of use in order to be granted a user ID and password for logging in to the Shop.

User IDs and passwords are personal, and the Savonlinna Opera Festival strongly suggests that the Customer should not disclose or transfer them to any third party. If the Customer suspects that his/her user ID and password have been obtained by a third party and are liable for abuse, the Customer shall immediately notify the Shop of this (verkkokauppa@oopperajuhlat.fi). Until the Customer does so, he/she shall remain liable for any and all transactions undertaken using his/her user ID. The Savonlinna Opera Festival shall be entitled at any time to block access to the Shop to any Customer who violates these terms and conditions of use or otherwise uses the Shop in violation of its terms and conditions of use or illegally. If the Customer for the aforementioned reason is excluded from or prevented from using the Shop, the Savonlinna Opera Festival shall not be liable to compensate the Customer for any losses the Customer may incur as a result.

4. The Customer is responsible for purchase decisions and for computer hardware
The Customer shall be responsible for his/her actions in the Shop. The Customer shall acquaint himself/herself with the products and make purchasing decisions independently. The Savonlinna Opera Festival shall not be responsible for providing the
Customer with user support if the Customer accesses the Shop using hardware, software or Internet connections of a kind not specified in the technical specifications. In case use of the Shop requires the Customer to acquire and install any hardware or software, the Customer shall be liable for such acquisition and installation.

5. Service providers are responsible for products sold at the Shop
For each product sold through the Shop there is a product description, which the Customer shall read before making a purchase decision. The product description includes information on the content and features of the product, its pricing, and its terms and conditions of booking, cancellation and sale. Service providers are responsible for ensuring that the product descriptions are valid and legal. When the Customer makes a booking or purchase through the Shop, the transaction shall be considered to have been conducted between the Customer and the relevant service provider.

6. Right of cancellation
A deposit charged in the Shop shall not be refunded under any circumstances. If the Customer wishes to cancel a booking, he/she must contact the service provider directly as specified in the terms and conditions of booking, cancellation and sale for the product in question.
 
7. Customer data file
The customer data file of the Shop is maintained by the Savonlinna Opera Festival. The Savonlinna Opera Festival shall collect no other information on the Customer except that which is necessary for managing the customer relationship, delivering products and charging payment for them and which the Customer himself/herself submits when accessing the Shop. This information shall be used for developing the Shop and for customer bulletins containing information necessary for accessing the Shop, the latter sent principally by e-mail. Customer data shall not be used for online marketing communications or direct marketing without the specific consent of the Customer and shall not be disclosed to third parties. The Customer may at any time refuse to receive marketing communications by notifying the customer service of the Shop (onlinesales@operafestival.fi).

8. Changes to these terms and conditions
The Savonlinna Opera Festival shall have the right to amend the content and functions of the Shop in order to improve its service or for any other compelling reason. Any downtime caused by alterations and maintenance to the service shall be announced at the Savonlinna Opera Festival website as and when possible. The Savonlinna Opera Festival shall have the right to alter the terms and conditions of use and hardware specifications of the service by notifying the Customer through the service or on the Savonlinna Opera Festival website. If the Customer does not accept the altered terms and conditions of use, he/she shall notify the customer service of the Shop, following which the Savonlinna Opera Festival shall terminate the Customer’s account in the Shop.

9. Contacts
Inquiries regarding the Shop and the products sold there shall be directed to the customer service of the Shop (only by e-mail, onlinesales@operafestival.fi), which is also responsible for maintaining the description of the Shop’s personal data file.
